Raleigh Attorneys File Lawsuit in ConAgra Foods Explosion

Workers Compensation Lawyer, David Stradley and Workers Comp Attorney, Nancy White were called to action by their clients to file Workers compensation claims and the first lawsuit after the Conagra Foods Slim Jim Plant in Garner, NC, exploded and caught fire on June 9, 2009, at the Conagra plant on Jones Sausage Rd. in Garner, NC.

In what Conagra lawsuit attorney Stradley best described as a natural gas explosion and “fireball” in the lawsuit papers filed in Johnston County and as reported by WRAL TV, the News & Observer and other media sources, a number of Conagra Workers were burned and badly injured.  Attorney Nancy White is representing a number of Conagra victims for Workers’ compensation claims.

A Conagra employee should know that attorneys White and Stradley recommend that the best path in many cases is to file for Workers compensation benefits and for damages through a lawsuit.  Even the best Workers’ compensation outcome in the Conagra Foods case will not cover pain and suffering and some other damages which are simply not provided through Workers’ compensation.

Attorneys White and Stradley have seen a number of different injuries from the Conagra explosion including burns, head injury, injury from being trampled, emotional and psychological trauma, joint injury, knee injury, shoulder injury and other problems resulting in disability.

Attorney Stradley has filed the first civil lawsuit in Smithfield, NC, in the Johnston County Superior Court.  This action has been followed closely by the news media including WRAL TV, WTVD, The News and Observer, News14, the Associated Press and others.  Attorney Stradley has attended the Chemical Safety Board new conference and has held a news conference at this office to answer questions about the Conagra lawsuit.

The Conagra lawsuit alleges that contractors working with a water heater and natural gas lines negligently allowed natural gas to leak or escape into the Conagra plant which then exploded.  Defendants in the lawsuit include Southern Industrial Constructors, Inc., Energy Systems Analysts, Inc., and Jacobs Engineering Group, Inc.

The Alcohol Tobacco and Firearms Bureau of the US Justice Dept. has announced that the explosion was likely caused by a natural gas leak and the US Chemical Safety Board has announced that natural gas was the cause of the explosion.

What makes the explosion at ConAgra even more upsetting is that the 50,000 square foot plant had previous safety violations dating back to 2006 and 2007 and even earlier. In 2001, a staggering 34 violations were recorded, and the plant had to pay OSHA a fine of over $12,000.
